Legal fees, representation and presence debated

After much discussion and debate, the Dorchester District Two Board of Trustees agreed to continue its investigation into legal representation and what would be best for the district.

Board members Lisa Tupper and Sam Cook make up the committee assigned the task but came to the Monday board meeting with concerns as to what information the board wanted.

The assignment originated with the charge by The Post and Courier that the board illegally discussed the superintendent’s evaluation during executive session. Further, the board was concerned that the attorney it had been using for construction matters was no longer with the law firm they were using and it felt the need to ensure it had specialized legal representation in light of the multi-million dollar construction project under way.

The DD2 Board wants to ensure it is following the letter of the law with regard to the Freedom of Information Act and that it is covered should issues arise with construction, personnel and if it needs the attendance of an attorney at meetings. It noted that the current representation was not an issue but that it would be irresponsible to not review how it [the board] does business on a regular basis.

Cook and Tupper reported they had information from a number of different law firms as to costs of representation.

The issue of having legal representation at every board meeting and executive session was discussed with the cost, $275 per hour, a concern.

The committee was instructed by the board to continue comparing services and costs and to report back.
